1. Critically analyze the factors that led to Alibaba sustaining its leadership position in the Chinese e-commerce market. During the late 1990ââ¬â¢s and early 2000ââ¬â¢s, the internet was not very popular in China and people were ignorant to its proper use. These tests measure individualââ¬â¢s responses to what are usually fixed choice questions to uncover characteristics that have important implications for their job performance (Beardwell and Claydon, 2007). Compare poems Boy driving his father to confession by Seamus Heaney and Praise song for my mother by Grace Nichols Essay When asked to compare the two poems à ¢Ã¢â ¬Ã¢â¬Å" Boy driving his father to confession by Seamus Heaney and Praise song for my mother by Grace Nichols the first thing that stuck out was the difference in layout. Seamus Heaneys poem is written in longer sentences and reads more like a story. Grace Nichols poem is a lot shorter with only two words in some lines and it compares her mother to various things. Seamus Heaney writes about his father in a realistic way, never praising him and only focussing on his bad points. Grace Nichols on the other hand only praises her mother, so much that I felt that this poem was a lie, nobody thinks that their parent is that perfect. Praise song for my mother is written in the past tense so maybe her mother is dead and she has written this poem in her memory, only praising her good points because maybe she feels guilty that they could have been closer. In the last line of the poem it says Go into your wide futures, you said perhaps the daughter went overseas and didnt see her mother for a long time and now feels guilty that while away her mother was ill and died and had to face this without her daughter by her side. I think its easier to see the good points in someone if you are away from them for a long time, you dont have to see their bad points and like the saying says absence makes the heart grow fonder. Boy driving his father to confession tells us about the difficult relationship between Seamus and his father. You are immediately aware of this in the title, instead of writing son he has written boy. I think that men find it difficult to talk about their feelings and emotions. Seamus Heaney tells us that on only four occasions has he seen his father let his guard down and show his emotions. The picture I get of his father is a very private man who keeps himself to himself he probably doesnt talk to his son about anything personal only to tell him to do his homework, wash the car, tidy the room etc. I also feel that if they had to discuss an item of news the father would not accept the sons point of view. The writer Grace Nichols is Caribbean and because of this has written her poem comparing her mother to various things found in the Caribbean, in line 12 she has written the flame trees spread to me followed by the crabs leg / the fried plantain smell. I think that my mother would be upset to be compared to something that I used to look for in rock pools on holidays. The diet of the Caribbean people is very different to ours. Her mother appears to have been very hippy like. Grace compares her to water, deep and bold and fathoming. I think that the mother understood her daughter well, and because of this allowed her to make her own decisions and perhaps learn by her own mistakes. In the second verse she compares her mother to the moon you were moons eye to me, pull and grained and mantling. Her mother would always look out for Grace, perhaps Grace didnt always agree with her mother but she always knew that her mother would protect her. The third verse you were sunrise to me rise and warm and streaming. This again shows the Caribbean influence with the reference to the sunrises à ¢Ã¢â ¬Ã¢â¬Å" more common there than in Wales. Seamus Heaney is an Irish, Roman Catholic, we know his religion from the end of the poem where he drops his father at the church so he can go to confession. The soul is the owner of its experiences and remains the same through your lifetime. The body and brain are physical while the soul is a mental substance. So in this case James Hartley has lost his soul. That soul which is the possessor of all his experiences including that of the murder is gone. So lets analyze James Hartleys situation based on the three perspectives of substance dualism given in the article. The basic awareness of the self states that our individual experiences make us unique. For only I possess my experiences which are solely mine. In this case we should stop calling him James Hartley for it is obvious he is no longer that person, he no longer possesses the experiences James Hartley had. In unity and the first person perspective it explains that no amount of third person descriptions of yourself can better describe you than you. I am I because I am aware of it through self-awareness. So James Hartley doesnt even know his name and is relying on others to tell him who he is. Physically he is James Hartley but mentally he is not. In the modal argument it states that if one could conceive an event than that event could be possible. It explains that we can easily conceive ourselves being disembodied but the same does not hold for our body and brain. We can mentally conceive ourselves being separated from the body. As stated in the article the soul is the owner of its experiences and is an enduring entity, meaning its not identical to its experiences it is in fact the conscious thing that has it. James Hartley in the article doesnt have any James Hartley experiences so that would simply mean his soul has somehow separated from his body. In Summary, it is not the body that makes the self it is the self that makes the body. If I were the sheriff I would not have gone through with the hanging. The reason doesnt even have anything to do with the story because I believe that ending someones life because you see it morally fit is an absurd idea. An eye for eye justice system is archaic and primitive. But to base it in the context of the story I would not have gone through with the hanging either because obviously somethings wrong with the person, he doesnt know who he is or what he has done. Its like youre hanging a newborn. Its just the body thats the same but inside its someone else. A medical checkup would need to be performed on the man to determine what has happened to him. What I mean by this is we would like to give in to the idea that we are intelligent because we ask all these questions others dont. I am smarter than you because I think and you dont. We shudder at the though t of gaining happiness through false beliefs. We do not believe that to be true happiness. Maybe just maybe this very fact is the only reason we choose to keep on looking for answers for things we very well know we cannot answer during our lifetime. To gain happiness via false beliefs is almost like gaining huge amounts of money through stealing. You cheated for your quick grab at happiness.

Simpson trial. People flocked to their favorite public places to be with friends so they could watch the trial together. In Time magazine, journalist Jill Smolowe, quoted Don Hewitt, executive producer of 60 Minutes, about the atrocity of making trials a spectator sport. Hewitt said, "I don't like the idea that a murder trial has been turned into an entertainment special. There are certain moments in American life that have certain dignity" (38). The judicial system is a very complex system and deserves the respect and dignity that is required. It needs to be taken seriously. The public has no right to make it into a game. Epics have been written and told orally for hundreds of years. A typical epic usually contains challenges, journeys, adventures and most importantly, a hero. An epic hero has several characteristics that make him unique. First of all, he or she usually comes from a noble family, which means, a noble birth. Also, they tend to have superhuman strength and accomplish beyond human deeds. A must in all Epic stories is that this hero must go on a quest in search of something. This quest, also known as a journey, holds several challenges and unexpected turns that the hero must overcome. Beowulf, an epic hero, is a fantastic example and fits the standards perfectly of an epic hero. He is noble, brave, and has superhuman strength, not only in his body but also in his heart. This strength is one that makes him thing of himself as immortal and invincible. What Beowulf lacks despite of this is a sense of self-knowledge, something learned about oneself through experiences, but he gains this characteristic through his epic quest in which he will realize that in fact, he is not immortal. Beowulf does not simply gain self-knowledge; in fact there are a series of events which lead up to his inner realization. Grendel is a powerful monster who terrorizes the Danes. He is feared of immensely by all of the people and nobody who has the courage to withstand him survives the attempt. ââ¬Å"He was spawned in that slime, conceived by a pair of these monsters born of Cain, punished forever for the crime of Abelââ¬â¢s death. â⬠(Line 19-23)Grendel is such a bad figure that he is known to be the reincarnation of the devil. When terrorizing all of the people at Herot, Hrothgar calls for Prince Beowulfââ¬â¢s assistance, knowing that he is powerful and brave. Beowulf sleeps at Herot and during the night confronts Grendel in a bloody and intense battle. Beowulf manages to kill Grendel and is therefore recognized and worshiped by all of the Danes. This is one of the first contributors to Beowulfââ¬â¢s belief of immortality in himself and a clear example to him that death in fact is possible. After having slayed Grendel, Beowulf is encountered in another situation in which he must, once again fight for Hrothgar. Hrothgar informs Beowulf that Grendelââ¬â¢s Mom hast taken and killed his best and only friend. He in turn asks Beowulf for help once again and Beowulf gladly accepts the task. ââ¬Å"Grendelââ¬â¢s Mom is hidden in a terrible home, in a place you have not seen. Seek it if you dare! Save us once more, and again twisted gold, heaped up ancient treasure, will reward you. â⬠(Line 444-449) He begins his journey to Grendelââ¬â¢s Momââ¬â¢s lair, a deep dark lake in the mountains to which nobody ever wants to go. When he gets there, Beowulf is attacked by several creatures other than Grendelââ¬â¢s Mom herself, but manages to kill them all and finally encounter himself in a battle with fearless Grendelââ¬â¢s Mom. After the long battle, Beowulf manages to kill this creature and again feels overly triumphant and immortal, but is yet another example of mortality shown clear to Beowulf, because everything, even the most dark and feared creatures can die. Fifty years later, Beowulf finds himself being king of the Geats and being greatly loved by everyone in his realm. One day, Beowulf is informed that a dragon is terrorizing his people and is killing them, a fire breathing dragon. ââ¬Å"Iââ¬â¢ve never known fear, as a youth I fought in endless battles. I am old now, But I will fight again, seek fame still, if the dragon hiding in his tower dares to face me. â⬠(Line 607-610). Despite his old age, Beowulf, still courageous, wants to fight and slay the dragon which terrorizes his people. Once he gets there and the battle begins, he realizes that it is not the same as before, that he is in fact weaker and now vulnerable. He struggles greatly, his sword breaks, and the dragon melts his shield and armor with his fiery breath, but now his army helps him and together they slay the dragon. Unfortunately, Beowulf is greatly wounded and for the first time, realizes he is going to die and that he is in fact, mortal. When he dies, Beowulf asks for a statue of him to be built, he is in this way seeking eternal immortality. His self-realization mainly comes across to him when he is dying in the arms of his people after his harsh fight with the dragon. He was a strong hearted and strong-minded warrior, because it was not until the last moment that he learns about his own vulnerabilities, he lives thinking he is invincible, until fate plays a trick on his belief.

It is an equitable remedy that compels a party to execute a contract according to the precise terms agreed upon or to execute it substantially so that, under the circumstances, justice will be done between the parties ( Hill, 2005). It is the right of the party to a contract to demand that the defendant (the party who it is claimed breached the contract) be ordered in the judgment to perform the contract. Specific performance may be ordered instead of (or in addition to) a judgment for money if the contract can still be performed, and money cannot sufficiently reward the pla intiff (Ibid). The basis for the grant of this remedy is equity. Doctrine of Partial Performance The doctrine of partial performance is an exception to the requirement prescribed by the Statute of Frauds that any agreement to transfer land must be written and executed. Partial Performance of an oral agreement can render it as a binding contract (Gervais et al, 2010). The essence of this doctrine was that if the plaintiff could show that he or she had acted under the contract - had partly performed the contract - then a court of equity would enforce the contract even though a court of law would not. The doctrine of part performance requires that the plaintiff must be able to show that he or she has made a substantial commitment to the contract so that it would be unconscionable to allow the defence. Note that it must be the acts of the plaintiff. The doctrine is based on the idea of unconscionability generated by the plaintiff's reliance on the existence of a contract. It does not ma tter whether the acts of the defendants clearly show that there is a contract (Heffey et al. 1998). Difference between the two doctrines and their application to construction cases The invocation of Specific Performance is based on a written contract or any agreement entered into by the parties. And non-performance of any provision or stipulation in the contract will make the erring party liable for breach of contract and an action for specific performance will be granted as in the case of Kasten Construction Co. v. Maple Ridge Construction Co.
